On November 20, 2013, Illinois became the 16th state to legalize same-sex marriage; this historic legislation, known as the “Religious Freedom – Marriage Act” is effective June 1, 2014. After June 1, 2014, in Illinois, married gay and lesbian couples will be treated the same as married heterosexual couples. Illinois will also, for the first time, recognize same-sex marriages performed in other states. Thus assuming jurisdictional requirements are met, same-sex couples married in a state where same-sex marriage is legal can get a divorce in Illinois.
Illinois has also enacted, “The Illinois Religious Freedom Protection and Civil Union Act,” which became effective in 2011. Section 20 of the law states that individuals who have entered into a civil union are entitled to the same legal obligations, responsibilities, protections and benefits that are afforded to spouses under Illinois law.
